　　最近，江蘇姑蘇區(qū)檢察院就公布了這樣一起餐飲“詐騙案”：一個(gè)4人為主犯的詐騙團(tuán)伙，通過(guò)冒充知名漢堡品牌，夸大利潤(rùn)率，提供后續(xù)服務(wù)保證等手段，來(lái)實(shí)施短期快速招商，詐騙了百余名餐飲人，詐騙金額近達(dá)億元。

　　Recently, the Procuratorate of Gusu District, Jiangsu Province, announced a food and beverage "fraud case": a fraud gang with four main culprits used various means such as impersonating a well-known hamburger brand, exaggerating profit margins, and providing follow-up service guarantees to implement short-term rapid investment promotion, defrauding more than 100 food and beverage people and defrauding nearly 100 million yuan.

　　1、碰瓷“名牌”：冒充知名漢堡新推出的品牌，騙取有意向加盟的創(chuàng)業(yè)者

　　2020年12月，董某想要?jiǎng)?chuàng)業(yè)，于是在網(wǎng)上搜索某知名漢堡品牌加盟事項(xiàng)時(shí)，留下了自己的聯(lián)系方式。

　　次日，一個(gè)自稱是某知名漢堡品牌總部大區(qū)經(jīng)理的人聯(lián)系董某，稱該品牌加盟費(fèi)需100萬(wàn)元以上，但其集團(tuán)新推出的“麥某德”品牌加盟費(fèi)較低，且提供專人指導(dǎo)運(yùn)營(yíng)，并邀請(qǐng)董某到現(xiàn)場(chǎng)體驗(yàn)。

　　The next day, a person claiming to be the regional manager of a well-known hamburger brand headquarters contacted Dong, stating that the franchise fee for the brand was over 1 million yuan, but the franchise fee for the newly launched "Maimou De" brand by the group was lower and provided dedicated guidance for operation. Dong was also invited to experience it on-site.

　　按照對(duì)方的安排，董某被專車接送至“麥某德”公司總部參觀，工作人員介紹“麥某德”公司隸屬于某知名漢堡品牌所屬集團(tuán)，與多家知名企業(yè)合作，且后期有平臺(tái)專員協(xié)助開店運(yùn)營(yíng)，加盟費(fèi)僅需12.6萬(wàn)元。

　　According to the other party's arrangement, Dong was transported by a special car to the headquarters of "Maimou De" company for a visit. The staff introduced that "Maimou De" company is affiliated with a well-known hamburger brand group, cooperates with multiple well-known enterprises, and later has platform specialists to assist in opening and operating stores. The franchise fee is only 126000 yuan.

　　參觀過(guò)程中，公司特意提供了試吃樣品，董某發(fā)現(xiàn)樣品的口味與知名漢堡品牌店里的無(wú)異。公司大屏循環(huán)播放明星代言視頻，宣傳墻上還懸掛著營(yíng)業(yè)執(zhí)照和其與各知名品牌的合作牌匾。

　　During the visit, the company specially provided trial samples, and Dong found that the taste of the samples was no different from those in well-known burger brand stores. The company's large screen plays celebrity endorsement videos in a loop, and there are also business licenses and cooperation plaques with various well-known brands hanging on the promotional wall.

　　親眼看到該公司的“雄厚實(shí)力”，董某深信不疑。該公司又說(shuō)道：“每款產(chǎn)品毛利率約70%，單店日均經(jīng)營(yíng)額可達(dá)5000元至1萬(wàn)元，六個(gè)月到九個(gè)月就可以回本”。

　　在對(duì)方的“洗腦式”推銷下，董某立即轉(zhuǎn)賬12萬(wàn)余元，并簽訂了《特許加盟合同書》加入加盟服務(wù)群。

　　然而，美夢(mèng)很快破滅。據(jù)董某介紹道：“公司要求從他們那里購(gòu)買漢堡制作物料，價(jià)格比市場(chǎng)價(jià)高一倍以上，口味卻與試吃的樣品天差地別。選址、設(shè)計(jì)等方面的服務(wù)更是外行、敷衍。由于生意不如預(yù)想的好，產(chǎn)品銷路不暢，物料積壓，我們請(qǐng)求公司回收卻被置之不理。后來(lái)由于運(yùn)營(yíng)成本過(guò)高，不到半年就關(guān)店歇業(yè)了。”

　　However, the dream was soon shattered. According to Dong, "The company requested to purchase hamburger making materials from them at a price more than twice the market price, but the taste was vastly different from the samples they tried. The services in site selection, design, and other aspects were also inexperienced and perfunctory. Due to business not doing as well as expected, product sales were not smooth, and materials were stockpiled. We requested the company to recycle but were ignored. Later, due to high operating costs, the store closed in less than six months

　　2023年7月，包括董某在內(nèi)的多名加盟商，意識(shí)到不對(duì)勁后，陸續(xù)報(bào)警。

　　2、 “皮包公司”：上演詐騙“三部曲”，向加盟商牟取暴利

　　警方經(jīng)查證，初步研判這是一起多人參與、涉案金額巨大、被害人眾多的合同詐騙案。

　　記者梳理后發(fā)現(xiàn)，這種“快招”形式的詐騙案主要分為三步，以此次事件為例：

　　第一步：引誘加盟商到店考察，結(jié)果試吃樣品都是冒充的

　　Step 1: Lure franchisees to visit the store for inspection, and the results show that the tasting samples are all fake

　　從以往受騙加盟商的經(jīng)歷來(lái)看，受騙過(guò)程一般從線上搜索開始。

　　Based on past experiences of being deceived by franchisees, the process of being deceived usually begins with online searches.

　　通常情況下，有加盟意向的用戶會(huì)去線上搜索自己希望加盟的品牌，但這恰恰是踏入深淵的第一步。

　　一旦通過(guò)虛假網(wǎng)站與加盟商取得聯(lián)系，快招品牌就會(huì)聲稱加盟商想加盟的知名品牌已經(jīng)接近于飽和或加盟費(fèi)偏高，然后說(shuō)自己的品牌是知名品牌的子品牌，再誘騙這些潛在的加盟商到線下的直營(yíng)門店來(lái)進(jìn)行考察。

　　Once contacted through a fake website, KuaiZhao brand will claim that the well-known brand that the franchisee wants to join is close to saturation or the franchise fee is high, and then claim that their brand is a sub brand of the well-known brand, and then lure these potential franchisees to visit their offline direct stores for investigation.

　　另外在此次案件中，公司還特意提供了試吃樣品。但其實(shí)據(jù)涉案人員交代，試吃環(huán)節(jié)中的試吃樣品也系從其他品牌門店購(gòu)買食品后，替換包裝冒充的自主研發(fā)產(chǎn)品。

　　In addition, in this case, the company also provided trial samples. But according to the person involved in the case, the tasting samples in the tasting process were also self-developed products that were purchased from other brand stores and replaced with packaging to impersonate.

　　第二步：斥資打造豪華辦公室，塑造“信任狀”

　　為了打消加盟商心中的顧慮，獲取他們的信任，快招品牌們還會(huì)特意通過(guò)打造豪華辦公室或者偽造品牌資質(zhì)等手段打造良好的形象。

　　像是這次，該犯罪團(tuán)伙中的段某甲就聯(lián)合朋友徐某、王某入股 成立“薩某堡”公司，斥資打造豪華辦公場(chǎng)地，并委托李某負(fù)責(zé)的W公司為其提供“快招”服務(wù)。

　　For example, this time, Duan Jia, a member of the criminal gang, joined forces with friends Xu and Wang to invest in the establishment of the "Sa Moubao" company, investing in the construction of a luxurious office space and entrusting W Company, which is managed by Li, to provide "quick recruitment" services.

　　但后期因遭到不少加盟商投訴舉報(bào)，“薩某堡”招商困難。段某甲為牟取更多利益，于2020年11月起聯(lián)合其堂弟段某乙成立“麥某德”公司，繼續(xù)委托W公司提供“快招”服務(wù)。

　　However, due to complaints and reports from many franchisees in the later stage, it was difficult for "Sa Moubao" to attract investment. Duan Moujia, in order to seek more benefits, joined forces with his cousin Duan Mouyi to establish "Mai Moude" company in November 2020, and continued to entrust W company to provide "quick recruitment" services.

　　“薩某堡”“麥某德”兩家公司與W公司約定，兩家公司負(fù)責(zé)提供場(chǎng)地、偽造品牌資質(zhì)、制作虛假宣傳資料、培訓(xùn)督導(dǎo)等，W公司則派駐商務(wù)團(tuán)隊(duì)招攬加盟商。

　　The two companies, "Saimou Bao" and "Maimou De", have agreed with W company that they will be responsible for providing venues, forging brand qualifications, producing false promotional materials, training supervision, etc. W company will dispatch a business team to recruit franchisees.

　　第三步：謊稱提供全方位配套服務(wù)，其實(shí)是想賺加盟商“全鏈條的錢”

　　Step 3: Falsely claiming to provide comprehensive supporting services is actually trying to earn franchisees' "full chain money"

　　除了打造”信任狀“外，這些快招團(tuán)隊(duì)還試圖借力知名品牌，賺錢餐飲全鏈條的錢。

　　一方面，快招品牌還會(huì)給予加盟商一系列承諾，如會(huì)在抖音、淘寶上大力做廣告推廣、營(yíng)造出火爆的簽約場(chǎng)面，從而獲得不菲的加盟費(fèi)。

　　在此次事件中，“薩某堡”“麥某德”兩家公司還設(shè)置培訓(xùn)陷阱，銷售高價(jià)物料牟取暴利。經(jīng)審計(jì)，兩家公司售賣的物料比市場(chǎng)價(jià)高一至兩倍，導(dǎo)致加盟商經(jīng)營(yíng)成本畸高，長(zhǎng)期處于虧損狀態(tài)。

　　In this incident, the two companies, "SaMouBao" and "MaiMouDe", also set up training traps and sold high priced materials to make huge profits. After auditing, it was found that the materials sold by the two companies were one to two times higher than the market price, resulting in abnormally high operating costs for franchisees and long-term losses.

　　但客戶繳納的加盟費(fèi)并不會(huì)投入公司運(yùn)營(yíng)，而是由兩家公司分成、其中76%的利潤(rùn)交給了W公司，剩余利潤(rùn)由段某甲等人瓜分。

　　But the franchise fee paid by the customer will not be invested in the operation of the company, but will be divided between the two companies, with 76% of the profits handed over to Company W, and the remaining profits divided among Duan and others.

　　3、兩家公司累計(jì)詐騙514名創(chuàng)業(yè)者，金額達(dá)9320萬(wàn)余元

　　3. Two companies have defrauded 514 entrepreneurs with a total amount of over 93.2 million yuan

　　經(jīng)審查，2020年8月至2020年12月，段某甲、徐某、王某伙同W公司人員，以“快招”的套路招募加盟商加盟“薩某堡”品牌，騙取210名被害人加盟費(fèi)4021萬(wàn)余元，因加盟商投訴舉報(bào)，案發(fā)前退還加盟費(fèi)及物料費(fèi)共計(jì)134萬(wàn)余元。

　　After examination, from August 2020 to December 2020, Duan, Xu, and Wang, together with personnel from Company W, recruited franchisees to join the "Samobao" brand using the "quick recruitment" tactic, defrauding 210 victims of franchise fees of over 40.21 million yuan. Due to complaints and reports from franchisees, a total of 1.34 million yuan in franchise fees and material costs were refunded before the incident.

　　2020年11月至2021年3月，段某甲、段某乙又以“快招”套路招募加盟商加盟“麥某德”品牌，騙取304名被害人加盟費(fèi)5299萬(wàn)余元，案發(fā)前退還加盟費(fèi)及物料費(fèi)共計(jì)206萬(wàn)余元。

　　From November 2020 to March 2021, Duan A and Duan B recruited franchisees to join the "Maimou De" brand using the "quick recruitment" tactic, defrauding 304 victims of franchise fees of over 52.99 million yuan. Prior to the incident, a total of over 2.06 million yuan in franchise fees and material costs were refunded.

　　2024年12月31日，段某甲、徐某、段某乙、王某4人，被法院以合同詐騙罪分別判處有期徒刑十年十個(gè)月至四年不等，各并處罰金50萬(wàn)元至10萬(wàn)元不等，并被責(zé)令繼續(xù)退賠被害人損失。另有5人已被姑蘇區(qū)檢察院以合同詐騙罪提起公訴，目前案件正在進(jìn)一步審理中。

　　On December 31, 2024, four individuals, Duan A, Xu, Duan B, and Wang, were sentenced by the court to imprisonment ranging from ten years and ten months to four years for contract fraud, with fines ranging from 500000 to 100000 yuan each. They were also ordered to continue compensating the victims for their losses. Another 5 people have been prosecuted by the Gusu District Procuratorate for contract fraud, and the case is currently undergoing further trial.

　　再次給餐飲人敲響警鐘：

　　餐飲雖然說(shuō)門檻低，但隱形的門檻并不低。普通人想要從中掙錢真的不容易，稍有不慎就會(huì)成為炮灰。
